There are special laws that apply to automobile accident cases. Those laws differ from an ordinary negligence case. There are certain time frames that exist in automobile accident cases and if you don’t follow those timeframes you can lose or waive important rights.
For example, you have a certain amount of time that you have to go get medical treatment. In addition, there are legal elements in an auto accident case regarding what type of threshold of injury you must receive in order to receive certain types of compensation. Laws in the personal injury arena are complex, the insurance companies made it that way.
I worked for a large insurance defense firm representing many insurance companies. While I was at that insurance defense firm I learned EXACTLY what they consider in a claim. I know how the insurance company attempts to defeat a claim. I know what they do in terms of their investigation. I know what they do in terms of their witness statements, and I understand the importance of getting into an accident case early, investigating the case early on behalf of an injured victim, and making sure you document things to protect you later on when an insurance company comes up with some lame excuse to deny your claim.
Our approach is to be very aggressive with the insurance company to protect you. Not to let them get a recorded statement but to make sure they understand that you have been injured. Make sure they understand the extent of your injuries and how that has impacted you in your life today, and how it’s going to impact your life in the future.
